Parlay (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy describes how Parlay collects, uses, discloses, and safeguards your information when you use our Services, and what choices you have with respect to it. Please read this Privacy Policy carefully.

APPLICABILITY OF THIS PRIVACY POLICY

This Privacy Policy applies to your use of Parlay’s Services (as defined in the Terms of Service) and other interactions (e.g., customer service inquiries, etc.) you may have with Parlay. If you do not agree with the terms of this Privacy Policy, do not access or use the Services or any other aspect of Parlay’s business.

If you are accessing or using Services from outside the United States, please be advised that through your continued use of the Services, which are governed by U.S. law, this notice, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer.

KEY TERMS

“Services” has the same meaning as in Parlay’s Terms of Service.

“User” means an individual 18 years of age or older who has registered for an Account to use the Services.

“User Information” means information about a User that is either provided to Parlay by the User or which Parlay gathers in other ways. “User Information” may include “Personal Information” and information which is not Personal Information, such as device information, location, frequency of use or other information about your use of Services.

“Personal Information” means any information that identifies or can be used to identify a User directly or indirectly. Examples of Personal Information include, but are not limited to, first and last name, date of birth, email address, phone number, or other demographic information.

THE INFORMATION WE COLLECT

The User Information that we may collect broadly falls into two categories: information Users provide to us and information we receive from Users through use of Services.

  • Information You Provide To Parlay : Using our Services requires you set up an account, which requires you provide us certain information.

    • To set up an account, you must provide us a username and password of your choice, an e-mail address, your phone number, your device phone book, and your age. We will also ask you to tell us what sports teams or athletes you root for.

    • Determining your eligibility to make, receive, or participate in a Friendly Wager, requires you provide us some additional information about yourself, including your state of U.S. residence, physical location, and date of birth.

    • To make or accept a Friendly Wager, you must provide us with your name, billing address, credit card information, and associated account information, which we share with our payment process, Braintree Payments .

    • If you contact us with a question or communicate with us in any other way (e.g., customer support inquiry), we will collect the information you volunteer.

  • Information We Receive Through Use of Services: When you use Services, Parlay collects information about how you use them. For example, we may collect information about how, when, and how often you use Services, and which Services you use. We may also collect information about your communications with other Users, such as their names or usernames and the time, date, and content of your communications. Other information we collect may include:

    • Device information: We collect information about the device and applications you use to access the Services, such as your IP address, your operating system, your browser ID, and other information about your system and connection.

    • Mobile Device Information: We may collect information about the type of device and operating system you use. We may ask for, access, or track any location-based information from your mobile device at any time while downloading or using our Services.

    • Device Phonebook: Because Parlay is about social connection through sports, we use your device’s phone book to identify other Users with whom you have a pre-existing relationship by comparing the phone numbers in your device’s phone book to our database of Users. Parlay does not retain any phone number, other than the User’s phone number, that does not return a match with a phone number in Parlay’s User database.

    • Log data: Our web servers keep log files that record data each time a device accesses those servers and those log files contain data about the nature of each access, which may include originating IP addresses. We may also access metadata and other information associated with files that you upload into our Services.

    • Product usage data: We collect usage data about you whenever you interact with our Services, which may include the dates and times you access the Services and your browsing activities (such as what portions of the Services are used). We may use mobile analytics software to better understand how people use our application. We also may collect information regarding the performance of the Services. This information allows us to improve the content and operation of the Services, and facilitate research and analysis of the Services.

HOW WE MAY USE YOUR INFORMATION

We may use User Information we collect through the Services for a range of reasons, including:

  • Providing Services. We use User Information to provide, maintain, update, protect, and improve our Services and business. This includes measurement, analytics, and other business services to help us and third parties with whom Parlay may partner.

  • Communicating with Other Users. By using the Services, you are agreeing to share and communicate certain Personal Information with other Users.

  • Communicating with You About Services. We may send you service, technical and other administrative emails, messages and other types of communications, or respond to your requests, comments, and questions. We may also contact you to inform you about changes in our Services, our Services offerings, and important Services-related notices, such as security and fraud notices. These communications are considered part of the Services and you may not opt out of them. In addition, we sometimes send emails about new product features, promotional communications or other news about Parlay. These are marketing messages so you can control whether you receive them.

  • Account Management and Other Administrative Matters. Parlay may need to contact you for account management and similar reasons and we use User Information and account data to administer your account.

  • Facilitating Payments. If you choose to make or accept a Friendly Wager, Parlay will maintain a record of your billing transactions and purchases, and any communications and responses.  Parlay may need to share your information with third parties in relation to these transactions.

  • Promoting Safety, Integrity, and Security. We may use User Information to investigate and help prevent security issues, fraud, and abuse, to verify compliance with our TOS, and to protect and defend the rights, property, and/or safety of Parlay, Users, or third parties, including enforcing contracts or policies.

  • To Comply with Laws. Parlay may use User Information to comply with applicable laws. If we receive a request for information, we may disclose User Information if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation or legal process.

  • During a Change to Parlay’s Business. If Parlay engages in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Parlay’s assets or stock, financing, public offering of securities, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities (e.g. due diligence), some or all Personal Information may be shared or transferred, subject to standard confidentiality arrangements.

  • Aggregated or De-identified Data. We may disclose or use aggregated or de-identified User Information for any purpose. For example, we may share aggregated or de-identified User Information with prospects or partners for business or research purposes.

  • Other Purposes. To carry out other legitimate business purposes, as well as other lawful purposes about which we will notify you.

  • With Consent. Parlay may share User Information with third parties when we have your consent to do so.

  • Third Party Services. Parlay may share User Information with third parties as necessary to provide Services. Third parties that have been granted access to User Information may have their own policies and practices for its collection and use. Please check the privacy settings and notices in these third party services or contact us with any questions.

DATA RETENTION

Parlay will retain User Information as necessary to provide Services, in accordance with a user’s instructions, the Terms of Service, and as required by applicable law. Parlay may retain User Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include keeping User Information after deactivation of a User’s account for the period of time needed for Parlay to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

AGE LIMITATIONS

Parlay does not allow use of our Services by anyone who is not eighteen (18) years of age or older. If you learn that anyone younger than eighteen (18) years of age is using the Services or has unlawfully provided us with Personal Information, please contact us and we will take steps to terminate or suspend use and delete such information.

PROTECTING YOUR PRIVACY

Parlay respects your privacy and takes reasonable precautions to protect the security of your information.

When you submit sensitive information to us, your information is protected both online and offline.

Wherever we collective sensitive or personally identifying information (such as your first and last name, date of birth, credit card or other financial information), that information is encrypted and transmitted to us in a secure way.

We also protect your information offline. Only those who need the information to perform a specific job (e.g., billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Despite reasonable precautions, given the nature of communications and information processing technology, Parlay cannot guarantee that your information, during transmission through the Internet or while stored on our systems or otherwise in our care, will be absolutely safe from intrusion by others.

DATA PROTECTION RIGHTS

We respond to all requests we receive from individuals with questions about our Privacy Policy or wishing to exercise their data protection rights in accordance with applicable data protection law. We may ask you to verify your identity in order to help us respond efficiently to your request. Users have the following data protection rights:

  • All Users: Parlay relies on Users to provide accurate, reliable, and up to date information necessary for use of Services. Users may manage many of your individual account and profile settings, or you may contact us directly by emailing us at support@parlayapp.com.

  • Users in the EEA: Users who are residents of the EEA can object to processing of their Personal Information, ask to restrict processing of their Personal Information or request portability of their Personal Information. You can exercise these rights by contacting us at support@parlayapp.com.

  • California Privacy Rights: Under California law, once a year, users who are California residents may request, free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with whom we shared personal information in the immediately preceding calendar year. Parlay does not disclose any personal information to unaffiliated third parties for these purposes.
